Our services include creative direction, search engine optimization, and consulting on ways to increase your brand presence, company outreach and effectiveness of your message. Our services are premium, though we offer these services at affordable packages, due to our business practices and tools. Inherent in these practices are limits which not only increase the effectiveness of our work together but allow for a clear stream of communication between parties. We will always do our best to fulfill your needs and meet your goals within the defined beneficial limitations and agreements.

A Part of Our Process - An Understanding of Time and Deliverables
As the Client, you have the power and ability to enter into this contract on behalf of your company or organization. You understand that, due to the nature of process, the dissemination of required assets and information is important in creating the best online tool for you within the agreed pricing. You agree to provide us with assets, copy, direction and other information required to complete the project when requested. You will do your best to send the aforementioned deliverables in the format requested. We will do our best to achieve the best possible quality from the received deliverables within reason and the scope of our agreement. You agree to review our work, provide feedback and sign-off approval in a timely manner. You also agree to stick to the payment schedule set out at the end of this contract, the amount of which is partially made possible by the resources conserved due to the deadlines in which we set. The deadlines that we set together are to be observed by both parties.
We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner. Along the way we will endeavor to meet all deadlines but cannot be held responsible for a missed launch date or deadline due to the late delivery of materials or required approval at any stage. We will always maintain the confidentiality of any information that you share with us.
Details of the works
We will create designs for the look-and-feel, layout, creative direction and functionality of your new web site. This contract includes one main design, based off of our industry-designed templates, plus the opportunity for you to make up to two rounds of revisions. We will do our best to interpret the needs of your business and meet its requirements while also providing professional advice as it relates to user experience, brand design, psychology and calls-to-action as to greatly improve the effectiveness of the website in generating qualified leads and optimal search returns, while boosting the presentation of Client. If you're not happy with the designs at this stage, you will pay us in full for all of the work that we have produced until that point and may either cancel this contract or continue to commission us to make further design revisions at our hourly rate of $250.00 per hour or daily rate of $750.00 for 6 hours.
We will test your website in current versions of all major browsers. We will also test to ensure that pages will display visually in a similar way across major devices, keeping in mind the reading and spatial requirements of browser sizes and use of your web application. All of this will be done to the greatest extend available through the Wix.com Platform (“the Platform”). Certain simplified design practices may be suggested in order to maintain mobile accessibility through the Platform.
Any additional testing or changes to accessibility and responsiveness will incur additional charges at an hourly rate of $60.00.
Content is exchanged through our On-Boarding Process.
On-Boarding is available through https://www.peakpoint500.com/member-onboard. This process may be facilitated by our representative(s). User access to the page will be granted once the initial information and payment is processed. You will receive a confirmation to the email given.
All text will be supplied by your or the Client during our on-boarding process. We are not responsible for writing any original text copy. We will, however, be available to edit down and rearrange the supplied copy in order to refine the message of your company and lead qualified consumers. We will also be happy to help and coach you on making changes required for maximum benefit.
If needed, you will supply us photographs in digital or printed format. We can also supply photography services at a separate cost to be determined upon the work required. Photography is a large factor in the success of your web presentation. We always suggest the highest possible standards of quality and resolution and will do our best to work with the supplied materials. If additional work or licensing is required outside of the scope of our agreement, we will notify you. Photography is otherwise provided through select high quality third-party collections at no cost to you.
Changes and Revisions
We know from plenty of experience that fixed-price contracts are rarely beneficial to you, as they often limit you to your first idea about how something should look, or how it might work. We don't want to limit either your options or your opportunities to change your mind.
The estimate/quotation at the end of this document is based on the number of days that we estimate are required within the limits of our PeakPointTM Process. If you do want to change your mind, add extra pages, extensions, widgets or even add new functionality, that won't be a problem. You may be charged the hourly rate of $250.00. However, that is based on the amount of new work you have asked for. A simple change of font, color of text, Image swap etc. will not be charged. We will always come to an agreement before you are charged for any extra work. Along the way we might ask you to put requests in email so we can keep track of changes. Additional Packaged changes are outlined at the end of this contract for reference.
A paid account to Wix is required for the use of our services. We will not charge you a fee for transferring site designs to your domain, nor any statistics software such as Google Analytics, or the implementation of your initial Search Engine Optimization requirements. Additional servicing and support may be discussed.
The Platform allows users to easily self-manage content, leads and customer lists - features that have allowed us to develop websites that become long-term tools for your success. If you require further comprehensive management you will be charged by the hourly rate of $250.00. We will train you or the Client (one person) on how to use your new management and publishing tools at no cost.
We can't guarantee that the functions contained in any web page templates or in a completed web site will always be error-free and so we can't be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Copyright of Assets
You guarantee that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by you, or that you have permission to use them. We will always use materials available for legal use, or custom designed, at no extra cost to you, unless previously identified and agreed upon. If we identify creative materials have been provided that are outside of a lawful copyright agreement, we reserve the right to omit the materials from the published website.
Copyrights Upon Payment
When we receive final payment, copyright is automatically assigned as follows:
You own text content, photographs and other data you provided, unless someone else owns them. Creator owns the graphics and other visual elements that we create for Client on this project. We will give you a copy of all required design assets as a part of your transferred site. Any use of our graphics, work or other visual elements outside of this project such as cloned websites, printed advertising or different platforms will be billed at an agreed upon rate.
We love to show off our work and share what we have learned with other people, so we also reserve the right to display and link to your completed project as part of our portfolio and to write about the project on web sites, in magazine articles and in books about web design.
Full payment is required to begin work on your site in total of the chosen services. Once designs are approved, your website will be transferred and published to your chosen domain. You will be updated and given the opportunity to review before publication in the limits of our agreement.
